These terms govern the use of the OpMetrics software product (the “Product”) and are entered into between the rights-holding company (the “Vendor”) and the organization using the Product (the “Client”).
By using the Product, the Client confirms it has read these terms and accepts them in full. If you use the Product on behalf of an organization, you confirm you are authorized to accept these terms on its behalf.
The Product is software for engineering-process analytics, provided as a cloud service (with self-hosted or dedicated deployment on the Enterprise plan) and processing data from the systems the Client connects: issue trackers, code repositories, monitoring and HR systems.
The Vendor grants the Client a non-exclusive, non-transferable license to use the Product within the paid contributor count and the subscription period.
All data processed by the Product remains the Client's property. On the cloud plan it is processed in the Vendor's isolated infrastructure, never shared with third parties; anonymized and aggregated indicators may be used to support and improve the Product. On the Enterprise plan (self-hosted / dedicated deployment) the Vendor has no access to the Client's data except where the Client explicitly grants it for technical-support purposes.
Data handling is described in the Privacy Policy.
The subscription price is determined by the current plan and the number of contributors — analysed employee profiles — whose data the Product processes. Billing is monthly or annual, at the Client's choice.
The free plan — up to 5 contributors — is available indefinitely; the paid subscription is priced by the number of contributors beyond five. A product demo on the Client's data is available on request. The Client's data is retained for the period stated in the Privacy Policy.
The Product provides analytical information to support management decisions. Decisions made on the basis of the Product's data remain the Client's responsibility. The Vendor is not liable for the Client's staffing or organizational decisions.
The Vendor's aggregate liability is limited to the amount the Client paid over the last twelve months of using the Product.
The Client may stop using the Product at any time. Accumulated data can be exported with the built-in export tools. An abandoned account (no sign-ins for 12 months) has its data deleted per the Privacy Policy; at the Client's request deletion is carried out immediately. On the Enterprise plan (self-hosted) the data stays with the Client.
The Vendor may update these terms. The Client is notified of material changes at least 30 days in advance. Continued use of the Product after the changes take effect constitutes acceptance of the new version.
